1. Agreement to Terms

By accessing or using OnCalm.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and OnCalm.io ("we," "us," or "our").

Note: OnCalm.io is currently in development and not yet formally established as a legal entity. Once incorporated in the European Union, we will update these Terms with complete legal entity information.

2. Description of Service

OnCalm.io provides an online platform for on-call engineering training through realistic incident simulations. The Service includes:

  • Interactive training scenarios and challenges
  • Real infrastructure environments (Kubernetes, databases, message queues, etc.)
  • Progress tracking and performance analytics
  • Educational content and resources
  • Community features (subject to availability)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and truthful

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service or other users
  • Extended periods of inactivity
  • At our discretion, with or without cause

5. Acceptable Use Policy

You agree NOT to:

  • Violate Laws: Use the Service for any illegal purpose or in violation of any laws
  • Abuse Infrastructure: Use the training environments for cryptocurrency mining, DoS attacks, or any purpose other than intended training
  • Share Credentials: Share your account credentials or allow others to access your account
  • Reverse Engineer: Attempt to decompile, reverse engineer, or discover source code of the Service
  • Circumvent Security: Bypass or circumvent any security features or access controls
  • Scrape Data: Use automated tools to scrape, index, or collect data from the Service
  • Interfere: Interfere with or disrupt the Service or servers/networks connected to it
  • Impersonate: Impersonate any person or entity or misrepresent your affiliation
  • Harass: Harass, abuse, threaten, or intimidate other users
  • Spam: Send unsolicited communications or spam through the Service
  • Distribute Malware: Upload or distribute viruses, malware, or malicious code
  • Infringe Rights: Violate intellectual property rights or other proprietary rights

6. Beta Access and Waitlist

The Service is currently in closed beta. By joining the waitlist or receiving beta access:

  • You acknowledge the Service may contain bugs, errors, or incomplete features
  • We make no guarantees about availability, performance, or data persistence during beta
  • Features and pricing may change before general release
  • Beta access does not guarantee access to the final product
  • We may collect feedback and usage data to improve the Service

7. Pricing and Payment

7.1 Pricing

[TO BE DETERMINED] Pricing information will be provided before the Service becomes generally available. Beta users may receive special pricing or discounts.

7.2 Payment Terms

When payment features are implemented:

  • You agree to pay all applicable fees as described on the pricing page
  • Payments are processed by third-party payment processors
  • All fees are exclusive of applicable taxes unless otherwise stated
  • Subscriptions automatically renew unless canceled
  • Refunds are subject to our refund policy (to be published)

8. Intellectual Property Rights

8.1 Our Rights

The Service and its content (including but not limited to text, graphics, logos, code, scenarios, and software) are owned by OnCalm.io or our licensors and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

8.2 Your Content

You retain ownership of any content you submit (feedback, comments, solutions). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and improving the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without restriction or compensation.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR and other applicable data protection laws.

By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the Service will be uninterrupted, error-free, or secure
  • That defects will be corrected
  • That the Service or servers are free of viruses or harmful components
  • The accuracy, reliability, or completeness of any content

Training Environment Disclaimer: The infrastructure scenarios are for educational purposes only. The Service simulates real incidents but should not be relied upon as a substitute for professional training, certification, or real-world experience.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OnCalm.io AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Unauthorized access to or alteration of your content or data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless OnCalm.io and its affiliates, officers, employees, agents, partners, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

13. Governing Law and Dispute Resolution

13.1 Governing Law

[TO BE DETERMINED] These Terms shall be governed by the laws of the European Union member state where OnCalm.io is incorporated, without regard to conflict of law principles.

13.2 Dispute Resolution

For EU consumers: You have the right to bring disputes before the courts of your habitual residence or before the competent courts where OnCalm.io is established, in accordance with EU consumer protection regulations.

For business users: Any disputes shall be resolved in the courts of the jurisdiction where OnCalm.io is incorporated.

13.3 EU Online Dispute Resolution

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new "Last updated" date
  • Sending an email notification to registered users (for significant changes)
  • Displaying a prominent notice on the Service

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may close your account.

15. Termination

15.1 Termination by You

You may terminate your account at any time by contacting us at info@oncalm.io or using account closure features in the Service.

15.2 Termination by Us

We may suspend or terminate your access immediately, without notice, for:

  • Breach of these Terms
  • Request by law enforcement or government agencies
  • Discontinuation of the Service
  • Technical or security issues
  • Extended periods of inactivity
  • At our discretion

15.3 Effect of Termination

Upon termination:

  • Your right to access the Service immediately ceases
  • We may delete your data in accordance with our data retention policy
  • You remain liable for all obligations accrued prior to termination
  • Provisions that should survive termination will continue to apply

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and OnCalm.io regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16.5 Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third parties.

16.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, pandemics, or government actions.
